Terms and Conditions of Service for Terapeas

Introduction

Welcome to Terapeas (the "Platform"), an online mental health and counseling service offering therapy through video calls, voice calls, chats, and additional offerings such as group therapy sessions, educational classes, and public Q&A with optional anonymity. By accessing or using the Platform, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these Terms, please do not use the Platform.

These Terms apply to individuals seeking therapy services through the Platform in all countries, including Malaysia, Indonesia, the UK, and the US.

1. Services Offered

Instantaneous Services:

  • Video Call, Voice Call, and Chat: Access therapists via video calls, voice calls, or chat messages in real-time on the Platform.

By Appointment Services:

  • Scheduled Video Calls or Voice Calls: You can schedule a session with a therapist at a mutually agreed time.

Additional Services:

  • Public Q&A Section (Optional Anonymity): Engage in an open, public Q&A space where anonymity is optional.
  • Classes and Group Sessions: Participate in group therapy or educational classes on various mental health topics.

2. Therapists and Therapist Services

Therapist Qualifications:

  • All therapists are licensed and credentialed in accordance with applicable laws and regulations in the jurisdictions where they operate.

Independent Providers:

  • Therapists are independent contractors and not employees of Terapeas. You may choose to change your therapist at any time if the services do not meet your expectations.

Limits of Therapy:

  • Terapeas is not designed for emergency situations. For crisis intervention, please contact emergency services in your region immediately

3. Privacy and Security

Confidentiality:

  • All sessions are confidential, with your personal information protected in accordance with our Privacy Policy. Personal data will only be shared as required by law or with your consent.

Security:

  • We use encryption and security protocols to safeguard your communications with therapists.

4. Payments, Fees, and Cancellation / Rescheduling Policy

Pay-As-You-Go Model:

Terapeas operates on a pay-as-you-go basis. You only pay for the services you use, without recurring subscriptions or membership fees.

Session Fees:

  • Appointment Sessions (Video Call, Voice Call, or Chat): The full cost of the session will be clearly displayed before you confirm your booking. You will be charged for the entire duration of the session, and this fee is fixed per session type (video call, voice call, or chat). The total amount is shown prior to confirming the booking.
  • Instantaneous Sessions (Video Call, Voice Call, or Chat): For instant services that are initiated immediately (without prior booking), you are charged per minute based on the type of service selected (video call, voice call, or chat). The minute-by-minute charge will be displayed in real-time as you use the service.
    • Example: If your video call lasts for 10 minutes and the per-minute rate is RM2, the total charge will be RM20 for that video call.

Top-Up System:

  • To use the services, you must top-up your account with funds. These funds will be deducted based on your session bookings and instantaneous calls. Any unused balance remains in your account and can be used for future sessions.

Payment Methods:

  • You can pay via credit card, debit card, or other available payment methods. All payments are processed securely.

Refund Policy:

  • Payments for completed sessions are non-refundable. However, if you experience technical issues or other service disruptions, you may contact us to request a refund or credit, which will be considered on a case-by-case basis.

 


 

Cancellation and Rescheduling Policy

Therapist's Policy Settings:

  • Each therapist or psychologist has their own cancellation and rescheduling policy, which is set by them and is clearly displayed during the booking process before you confirm your appointment. This ensures that you are aware of the therapist's specific terms before you finalize the booking.
  • Policy Types:
    • Flexible Policy: You may cancel or reschedule your session up to 24 hours before the scheduled appointment without incurring any charges.
    • Moderate Policy: You may cancel or reschedule your session up to 3 days before the scheduled appointment without incurring any charges.
    • Very Strict Policy: You may cancel or reschedule your session up to 7 days before the scheduled appointment without incurring any charges.

5. Arbitration and Dispute Resolution

Arbitration Agreement:

  • By agreeing to these Terms, you consent to resolve disputes through binding arbitration instead of litigation. This includes disputes related to your use of the Platform or services provided by Terapeas, including claims by or against third parties (e.g., spouses, heirs, beneficiaries, etc.).

Survival of Arbitration Agreement:

  • This arbitration agreement will remain in effect even after the termination or expiration of your relationship with Terapeas.

6. Your Account and Conduct

Account Accuracy:

  • You agree to provide accurate, current, and complete information during registration and to maintain it throughout your use of the Platform.

Account Access:

  • You are responsible for keeping your account credentials confidential. If unauthorized use of your account occurs, you must notify us immediately.

Conduct Guidelines:

  • You agree not to use the Platform for:
    • Sending unsolicited emails, ads, or promotional content.
    • Posting malicious content or software.
    • Posting unlawful, abusive, or harassing content.
    • Engaging in any activity that could cause damage or harm to others.

Indemnification:

  • You agree to indemnify and hold Terapeas harmless from any claims, losses, or damages arising from your use of the Platform, including violations of these Terms.

7. Modifications and Termination

Platform Modifications:

  • Terapeas reserves the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice.

Service Interruptions:

  • While we aim to provide consistent access to the Platform, we cannot guarantee 100% uptime due to technical or maintenance issues.

 


 

8. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of Malaysia. Disputes will be resolved through arbitration as set forth above, except where prohibited by Malaysian law.

 


 

9. Miscellaneous

Changes to the Agreement:

  • Terapeas reserves the right to change these Terms at any time. Changes will be posted on the Platform, and continued use of the Platform constitutes your acceptance of the modified Terms.

Entire Agreement:

  • This Agreement constitutes the entire understanding between you and Terapeas regarding the use of the Platform. It supersedes any prior agreements or representations.

If you are in crisis or experiencing a medical emergency, please contact local emergency services immediately. Terapeas is not intended for emergency mental health situations.
